Wanata Studio Terms of Use

Welcome to Wanata Studio. These Terms of Use ("Terms", "Agreement") govern your access to and use of mobile applications, features, content, and services (collectively, the "Services") provided by Wanata Studio ("Wanata", "we", "us", or "our"), including our Android application Assistive Touch.

By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not install or use any application from Wanata Studio.

1. License Grant and Permitted Use

Subject to your compliance with these Terms, Wanata Studio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use a copy of our applications on a compatible Android device that you own or control, solely for your personal, non-commercial purposes.

You agree not to:

• Copy, modify, adapt, translate, create derivative works from, or distribute the application or any part thereof;
• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the application, except to the extent permitted by applicable law;
• Rent, lease, lend, sell, sublicense, or otherwise make the application available to any third party for commercial gain;
• Use the application in any unlawful manner, for any illegal purpose, or in any manner inconsistent with these Terms;
• Interfere with, disrupt, or compromise the integrity or security of our services or infrastructure.

2. Device Permissions and System Capabilities

To provide core navigation, quick actions, and screen overlay features, our applications may request specific device privileges:

• Display Over Other Apps (Overlay): Allows the floating assistive button, virtual touchpad, and menu panels to stay accessible over other running applications.
• Foreground Service (FGS): Ensures continuous responsiveness of the floating widget and ongoing notification status.
• Accessibility Service (Optional): Required only for executing user-initiated navigation commands (such as Back, Home, Recent Apps, Lock Screen, Power Menu, and Split Screen), taking screenshots, virtual trackpad gestures, and applying per-app visibility rules. This service does not read text messages, personal data, or on-screen content.
• Device Administrator Permission: Certain applications or features may request Device Administrator access solely to provide instant one-tap screen locking without waking or disturbing the device.
• Do Not Disturb (DND) Access: Required to switch between sound, vibration, and mute states upon user request.

You retain full control over these permissions and may enable or revoke them at any time within your device’s system settings.

3. Pro Features, Purchases, and Subscriptions

Certain advanced capabilities (such as additional floating shortcut buttons, per-app gesture profiles, and cloud or local configuration backup/restore) may be offered as optional Pro features.

• All in-app purchases or subscriptions are processed securely through the Google Play Store and are subject to Google Play’s Terms of Service and billing policies.
• Prices and features included in Pro tiers are subject to change, with reasonable advance notice where required.
• Refund requests are governed by Google Play’s refund guidelines. If you have inquiries regarding an order, you may also reach out to our team with your Google Play transaction details.

4. Third-Party Services and Advertisements

Our free versions may display advertisements provided by third-party advertising networks (such as Google AdMob). These third-party services may collect device identifiers and advertising data in accordance with their respective privacy policies. Wanata Studio does not endorse and is not responsible for any third-party products, services, or websites linked or advertised within the app.

5. Intellectual Property Rights

All title, ownership rights, trademarks, service marks, logos, icons, graphics, design assets, and intellectual property rights in and to Wanata Studio applications and services remain the sole property of Wanata Studio and its licensors. Nothing in these Terms grants you any right, title, or interest in Wanata Studio’s trademarks or trade secrets.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Wanata Studio does not guarantee that the application will function uninterrupted, error-free, or compatible with every Android device manufacturer, hardware specification, custom ROM, or operating system update.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WANATA STUDIO, ITS DEVELOPERS, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY ERRORS OR INTERRUPTIONS IN THE APP; OR (III) ANY SYSTEM MODIFICATIONS OR REBOOT ACTIONS PERFORMED ON YOUR DEVICE.

8. Termination

You may terminate this Agreement at any time by stopping all use of our Services and uninstalling the application from your devices. Wanata Studio may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including breach of these Terms.

9. Changes to These Terms

Wanata Studio reserves the right to modify or update these Terms of Use at any time. When modifications occur, we will update the "Effective date" at the top of this document. Your continued use of the application following the posting of updated Terms constitutes your agreement to the revised Terms.

10. Governing Law and Contact

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to conflict of law provisions.
